These Terms & Conditions ("Terms") govern your use of any section our website (the "Website"), our mobile application (the "App"), and the services we offer through the Website or App. By accessing or using our Website or App, you agree to comply with these Terms. Please read them carefully.
By using the HOTSPOTTER App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2.1. User Accounts: To use certain features of the HOTSPOTTER App, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials.
2.2. Age Restriction: You must be at least 18 years old to use the HOTSPOTTER App. If you are under 18, you may only use the App with the consent and supervision of a parent or guardian.
2.3. Subscription: Access to some features of the App may require a monthly subscription, which includes a trial period. You will be billed for the subscription fee according to the pricing and billing terms provided in the App.
2.4. Acceptable Use: When using the App, you agree to comply with these Terms and all applicable laws. You may not use the App in any unlawful, fraudulent, or abusive manner. Prohibited activities include, but are not limited to:

2.5. User Content: The App may allow you to post, upload, or provide content, such as reviews and comments ("User Content"). We do not claim ownership to your User Content. However, by submitting User Content, you grant HOTSPOTTER a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, fully sublicensable right and license to use, reproduce, distribute, create derivative works, publicly display/perform, transmit, and publish the User Content.

We may monitor, edit or remove any User Content for violation of the letter or spirit of these terms, violation of our editorial policy or for any other lawful reason. However, we have no obligation to look for, edit or remove any User Content for any reason including, without limitation, violation of these terms.
Failure to comply with these terms of use may result in the withdrawal of the content, suspension or termination closure of your HOTSPOTTER account, without prejudice to any other legal action that we may take and/or claim for damages that we may be entitled to formulate.
Your use of the HOTSPOTTER App is also governed by our Privacy Policy, which can be found at Privacy Policy. By using the App, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
Your HOTSPOTTER membership will continue until terminated. To use the HOTSPOTTER service, you must have Internet access and a HOTSPOTTER-compatible device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party.
We may from time to time offer special promotional offers, plans, or memberships (`"Offers`"). Offer eligibility is determined by HOTSPOTTER at its sole discretion, and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Members of households with an existing or recent HOTSPOTTER membership may not be eligible for certain introductory Offers. We may use information such as device ID, method of payment, or an account email address used with an existing or recent HOTSPOTTER membership to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign up for the Offer or in other communications made available to you.
6.1. Billing Cycle: The membership fee for the HOTSPOTTER service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the `"Account`" page. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service.
6.2. Payment Methods: To use the HOTSPOTTER service, you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee.
6.3. Updating your Payment Methods: You can update your Payment Methods at your own discretion. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
6.4. Cancellation: You can cancel your HOTSPOTTER membership at any time, and you will continue to have access to the HOTSPOTTER service through the end of your billing period. Payments are non-refundable, and we do not provide refunds or credits for any partial membership periods or unused HOTSPOTTER content.
6.5. Changes to the Price and Subscription Plans: We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.
7.1 You are responsible for any activity that occurs through the HOTSPOTTER account. By allowing others to access the account, you agree that such individuals are acting on your behalf and that you are bound by any changes that they may make to the account.
8.1. The HOTSPOTTER service is provided "as is" and without warranty or condition. We do not warrant that the App will be error-free, secure, or uninterrupted. HOTSPOTTER makes every effort to provide accurate and up-to-date information on the App. However, we do not guarantee the accuracy, completeness, or reliability of any content, including but not limited to text, images, product descriptions, reviews, or any other materials found on our platform. While we strive to minimize errors and omissions, there may be instances where inaccuracies or incomplete information are present on our platform. If you identify any such errors or omissions, please notify us immediately.
8.2. Limitation of Liability: To the maximum extent permitted by law, HOTSPOTTER shall not be liable for any indirect, special, incidental, or consequential damages, or for loss of profits, data, or business, arising from your use of the App. HOTSPOTTER's total liability for any claims arising out of or relating to these Terms or the App shall be limited to the amount you paid for the App, if applicable.
8.3 Third party sites and content: Our Website, App and/or the Materials may contain links to third party websites. If you decide to visit any third party site, you do so at your own risk. We are not responsible for the content, accuracy or opinions expressed on such websites. Links do not imply that we are affiliated or associated with such websites. Third party content may appear on the Website or App or may be accessible via links from the Website or App. We are not responsible for and assume no liability for such content.
9.1. Where permitted under the applicable law, you and hotspotter agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
10.1. Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of the Netherlands.
10.2. Unsolicited Materials: HOTSPOTTER does not accept unsolicited materials or ideas for HOTSPOTTER content and is not responsible for the similarity of any of its content to materials or ideas transmitted to HOTSPOTTER.
10.3. Customer Support: For more information about our service and its features or if you need assistance with your account, please visit the HOTSPOTTER website or contact us directly. In the event of any conflict between these Terms and information provided by Customer Support or other portions of our website, these Terms will control.
10.4 Security: We maintain the highest standards of security, however the transmission of information via the internet is never completely secure. So, whilst we will do our best to protect your personal information, we cannot ensure the security of your data transmitted. Any transmission is at your own risk. Once we have received your personal information we will use strict procedures and security features to prevent unauthorised access.
10.5. Survival: If any provision or provisions of these Terms shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
10.6. Changes to Terms of Use and Assignment: HOTSPOTTER may, from time to time, change these Terms. We will notify you at least 30 days before such changes apply to you. If you do not wish to accept the changes, you can cancel your subscription before they take effect. We may assign or transfer our agreement with you, including our associated rights and obligations, at any time, and you agree to cooperate with us in connection with such an assignment or transfer.
10.7. Electronic Communications: We will send you information relating to your account (e.g., payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example, via emails to your email address provided during registration.
